In a recent legal move, Apple has initiated a lawsuit against OpenAI in a U.S. federal court. The tech giant accuses the artificial intelligence company of improperly acquiring confidential trade secrets that pertain to Apple’s hardware development, manufacturing procedures, and supply chain management. The core of the allegations suggests that former Apple employees, who later joined OpenAI, retained and shared proprietary information, potentially giving OpenAI an edge in their development of anticipated consumer AI hardware products.
The detailed complaint from Apple outlines that the alleged misconduct involved more than just passing on confidential information. It claims that former employees accessed sensitive data, reached out to Apple’s suppliers, and sought to extract crucial details during recruitment processes. Notable figures in the lawsuit include Chang Liu, accused of not returning an Apple-issued work laptop upon his departure, and Tang Yew Tan, a former senior executive at Apple who transitioned to OpenAI as its Chief Hardware Officer. Apple alleges Tan engaged in discussions with OpenAI affiliates and suppliers before leaving the company.
Apple further contends that OpenAI and its related entities have systematically targeted the company’s confidential technology, product development methodologies, and supply chain connections. This alleged strategy, Apple asserts, is part of OpenAI’s effort to speed up its entry into the consumer AI hardware market space. According to Apple, over 400 former Apple employees are now employed at OpenAI, and despite previously raising the issue directly with OpenAI, the tech company claims it received no response.
Seeking legal recourse, Apple is asking the court for both preliminary and permanent injunctions to halt the purported misuse of its trade secrets. Additionally, Apple is pursuing financial compensation for what it describes as deliberate and harmful misappropriation of its confidential business information. As of now, OpenAI has not issued any public comment regarding the lawsuit or the allegations levelled by Apple.
